SEA 76 (FAIRNESS Act): lo que entro en vigor el 1 de julio de 2026 y lo que tienes que saber

El Gobernador Mike Braun firmo la Ley SEA 76 -- conocida como la FAIRNESS Act -- el 5 de marzo de 2026. Esta ley entra en vigor el 1 de julio de 2026 y tiene implicaciones directas para la comunidad latina e inmigrante de Indiana. Esta guia te explica que dice la ley, lo que cambia, y -- muy importante -- los derechos que la ley NO elimina.
LO QUE REQUIERE LA LEY
1. La policia y el gobierno DEBEN cooperar con ICE
Toda autoridad de Indiana -- policia local, sheriffs, jails del condado -- debe cumplir con las solicitudes de detencion (detainers) de ICE. Ya no pueden ignorar o declinar estas solicitudes. Penalizacion por no cumplir: hasta $10,000 por violacion. El gobernador puede retener fondos estatales a gobiernos locales que no cumplan.
2. Escuelas, universidades y hospitales son "cuerpos gubernamentales"
La ley aplica a distritos escolares, universidades publicas, hospitales publicos, y todas las agencias gubernamentales del estado. Estos no pueden tener politicas que limiten o restrinjan el cumplimiento de las leyes federales de inmigracion. Nota: Las escuelas charter pueden no estar incluidas en la misma definicion que los distritos escolares publicos.
3. Empleadores deben verificar la elegibilidad de trabajo
Todas las empresas en Indiana deben verificar que sus empleados tengan autorizacion legal para trabajar. El Fiscal General puede investigar y demandar a empleadores que contraten a trabajadores sin documentos. Penalizacion: cierre de operaciones por hasta 5 dias para empleadores que violen esta regla -- incluso si el error fue no intencional.
4. Hospitales reportaran a partir de enero 2027
Los hospitales deben comenzar a documentar y reportar el tipo de identificacion presentada por pacientes de Medicaid a partir del 1 de enero de 2027. Esto aun no entra en vigor el 1 de julio de 2026.
5. LOS DATOS DE BENEFICIOS NO PUEDEN USARSE PARA PENALIZAR
Una enmienda importante incluida en la ley: los funcionarios NO pueden usar datos de beneficios publicos (como Medicaid, SNAP/food stamps) para investigar o penalizar a individuos. Esto fue incluido para proteger a personas que reciben servicios publicos.
LO QUE LA LEY NO TE QUITA -- TUS DERECHOS SIGUEN EN VIGOR
La SEA 76 obliga a INSTITUCIONES GUBERNAMENTALES a cooperar con ICE. Esta ley no elimina tus derechos constitucionales individuales. Estos derechos permanecen:
La 4ta Enmienda sigue aplicando: ICE NO puede entrar a tu CASA sin una orden judicial firmada por un juez (judicial warrant). Una "orden administrativa" firmada por un funcionario de ICE -- no un juez -- NO les da el derecho a entrar a tu hogar. Tienes el derecho de NO abrir la puerta.
Tienes el derecho de GUARDAR SILENCIO. No tienes que responder preguntas sobre tu estatus migratorio, tu pais de origen, o como entraste a EE.UU. Puedes decir: "Invoco mi derecho a guardar silencio."
Tienes el derecho a un ABOGADO. Si eres arrestado o detenido, pide hablar con un abogado antes de firmar cualquier documento.
Tienes el derecho a NO firmar documentos que no entiendes. No firmes nada bajo presion sin hablar primero con un abogado.
Tienes el derecho a contactar al CONSULADO de tu pais. Los consulados tienen obligacion de asistir a sus ciudadanos.
Los datos de Medicaid y SNAP NO pueden usarse para investigarte o penalizarte bajo esta ley. Si recibes beneficios, puedes seguir haciendolo.

Governor Mike Braun signed Senate Enrolled Act 76 -- known as the FAIRNESS Act -- on March 5, 2026. This law takes effect July 1, 2026 and has direct implications for Indiana's Latino and immigrant communities. This guide explains what the law says, what changes, and -- very importantly -- the rights the law does NOT eliminate.
WHAT THE LAW REQUIRES
1. Police and government MUST cooperate with ICE
All Indiana authorities -- local police, county sheriffs, county jails -- must comply with ICE immigration detainer requests. They can no longer ignore or decline these requests. Penalty for non-compliance: up to $10,000 per violation. The governor can withhold state funding from non-compliant local governments.
2. Schools, universities, and hospitals are 'governmental bodies'
The law applies to school districts, public universities, public hospitals, and all state government agencies. These cannot have policies that limit or restrict compliance with federal immigration laws. Note: Charter schools may not fall under the same definition as public school districts.
3. Employers must verify work authorization
All businesses in Indiana must verify that their employees have legal authorization to work. The Attorney General can investigate and sue employers who hire workers without documents. Penalty: operational shutdown for up to 5 days for employers who violate this rule -- even if the violation was unintentional.
4. Hospitals will report starting January 2027
Hospitals must begin documenting and reporting the type of ID presented by Medicaid patients starting January 1, 2027. This does NOT take effect on July 1, 2026.
5. BENEFITS DATA CANNOT BE USED TO PENALIZE INDIVIDUALS
An important amendment included in the law: officials CANNOT use public benefits data (like Medicaid, SNAP/food stamps) to investigate or penalize individuals. This was included to protect people who receive public services.
WHAT THE LAW DOES NOT TAKE AWAY -- YOUR RIGHTS REMAIN IN FORCE
SEA 76 requires GOVERNMENT INSTITUTIONS to cooperate with ICE. This law does not eliminate your individual constitutional rights. These rights remain:
The 4th Amendment still applies: ICE CANNOT enter your HOME without a judicial warrant signed by a judge. An "administrative warrant" signed by an ICE official -- not a judge -- does NOT give them the right to enter your home. You have the right to NOT open the door.
You have the right to REMAIN SILENT. You do not have to answer questions about your immigration status, country of origin, or how you entered the U.S. You can say: "I invoke my right to remain silent."
You have the right to an ATTORNEY. If you are arrested or detained, ask to speak with a lawyer before signing any documents.
You have the right to NOT sign documents you do not understand. Do not sign anything under pressure without first speaking to a lawyer.
You have the right to contact your country's CONSULATE. Consulates are obligated to assist their citizens.
Medicaid and SNAP data CANNOT be used to investigate or penalize you under this law. If you receive benefits, you can continue doing so.
